What is Service of Process?

Service of Process is a term used in our courts. Every court case has a process that must be followed. When suing someone, you have to be able to prove that they have been notified that they are being sued. In order to eliminate the chances of someone hiding from a lawsuit, every state requires you to maintain a registered agent or statutory agent. Their duty is to be open during normal business hours and they HAVE to accept service of process or basically any document that someone decides to drop off to the registered agent.

A process server can literally just throw a legal document at the registered agent or on the doorstep and file an affidavit that they served the registered agent with service of process. Service of process is usually a copy of the court documents that were not filed.

SOP is basically industry lingo for service of process.

When service of process happens, the law suit can legally continue because there is proof that the party being sued has been notified.

This is why it is important to hire a legitimate registered agent. Listing an employee, friend, or relative as your agent will not bestow the importance of their role. A process server could serve them and they wouldn t understand the importance of the service and would not have an efficient way to get the document to you.
